1. Scope and provider

These terms govern the use of tervolt.com (the "Site"), operated by Clu Swiss Security AG, Oberallmendstrasse 18, 6300 Zug, Switzerland (see the Impressum). By using the Site, joining the waitlist, or creating an account, you accept these terms.

2. Information and waitlist only — no offer

During the current phase, the Site provides information about the planned Tervolt platform and a waitlist for early access — nothing more. No investments can be made, no money is accepted, no financial instruments are offered, and no contractual claim to a future investment opportunity arises from joining the waitlist or "reserving" a package in the preview dashboard. Nothing on the Site constitutes an offer of securities, an invitation to invest, a financial promotion in any jurisdiction where such a promotion would be unlawful, or investment, legal, or tax advice. All figures — including target returns — are illustrative. See the Risk Disclosure.

3. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to join the waitlist or create an account. The Site is directed at residents of the European Union; if you access it from elsewhere, you are responsible for compliance with your local laws.

4. Waitlist and referral program

Joining the waitlist requires a valid email address and consent to receive updates; you can leave the waitlist at any time via the unsubscribe link. Each member receives a personal referral link; referrals move the referrer up the waitlist. Referral bonus: if and when real investing launches, referrers are intended to receive a bonus credit equal to 5% of the first investment made by each person who joined through their link. This program is non-binding until launch, subject to regulatory approval and final program terms, may be modified or withdrawn, creates no entitlement before launch, and any credit is issued by Tervolt — it is never deducted from the referred investor. Self-referrals, automated sign-ups, misleading promotion, and paid placement of referral links are prohibited; we may remove entries and revoke referral standing obtained this way. Waitlist position and any early-access perks are granted at our discretion and carry no monetary value.

5. Account and preview dashboard

The dashboard is a demonstration with mock data, permanently labeled as illustrative. It does not represent real holdings, real earnings, or real facilities. You are responsible for keeping your credentials confidential. We may suspend accounts that abuse the service or attempt to circumvent security.

6. Acceptable use

You agree not to: scrape or mass-download content; probe, breach, or test the security of the Site; submit false information; interfere with the service or other users; or use the Site for unlawful purposes.

7. Intellectual property

All content, branding, design, and software on the Site belong to Clu Swiss Security AG or its licensors and may not be reproduced or reused without prior written permission, except as permitted by mandatory law.

8. Liability

The Site is provided "as is" and free of charge. We are liable without limitation for intent and gross negligence, and for injury to life, body, or health. For simple negligence we are liable only for breaches of essential contractual duties (Kardinalpflichten), limited to the foreseeable damage typical for this kind of service. Forward-looking statements on the Site involve uncertainty and may not materialize; we accept no liability for decisions based on them.

9. Changes to these terms

We may amend these terms with effect for the future, in particular when the product moves into a new phase. The version published on this page applies. Material changes affecting account holders will be announced by email.

10. Governing law and venue

Swiss law applies, excluding its conflict-of-laws rules and without prejudice to mandatory consumer protections of your country of habitual residence. The exclusive place of jurisdiction is Zug, Switzerland, to the extent legally permissible. Should individual provisions be invalid, the remainder stays in force.

This is a working draft published for transparency during the waitlist phase. A lawyer-reviewed version (with localized translations) will replace it before launch.
